Investigators say O’Brien, who retired from the force in 2009, drove to the intersection of Stocco and North streets to confront a driver who had been running a stop sign after going erratically at the intersection.
The driver pulled out a gun, fatally shooting O’Brien.
He is accused of lying to investigators, including on a witness statements statement given to them by the driver.
Both O’Brien and the other suspect are also charged with three counts of accessory after the fact to murder, conspiracy to commit murder, possession of a firearm with intent to commit murder and firearms offences.
O’Brien was in custody at an east-end correctional facility on Tuesday and has a date of next court appearance for March 3. He is currently out on bail.
